Terms of service
These terms apply when you browse exaar.store or buy from EXAAR, including through the Shop app. By placing an order, you agree to these terms. Nothing in these terms limits any rights you have under the consumer protection laws of the place where you live.
1. Who we are
EXAAR sells e-bike upgrades and accessories online. We are based in British Columbia, Canada. Contact: exaarstore@gmail.com.
2. Products, descriptions and compatibility
We describe each product as accurately as we can, including voltage, connector type and the models it is listed for. E-bikes vary between model years and sellers, so you are responsible for checking that a part is compatible with your e-bike before you order, including voltage, connector/pin layout, mounting and wiring. If you're not sure, contact us before ordering with your bike model and a photo of the part you're replacing. A product listed for specific models has not been confirmed for other models unless the listing says so.
3. Pre-orders
Products marked "Pre-order" are not in stock at the time of purchase. They ship when new stock arrives. You are charged when you place the order. If we can't ship a pre-order within the time shown on the product page, or within 30 days of your order if no time is shown, we will email you with an updated date and you may cancel for a full refund. You can also cancel a pre-order for a full refund at any time before it ships.
4. Prices and payment
Prices are shown on the product page and confirmed at checkout. Payments are processed securely by Shopify. Taxes, duties and shipping are calculated at checkout. If a price is clearly a mistake, we may cancel the order and refund you in full.
5. Shipping and delivery
See our Shipping Policy. Delivery estimates are estimates, not guarantees, but we will keep you informed of delays as described above.
6. Returns, refunds, defects and warranty
See our Refund, Return and Warranty Policy.
7. Installation and safe use
Many of our products affect how an e-bike stops, accelerates or is powered. You agree to:
- follow the installation instructions and any manufacturer instructions that come with the product;
- have safety-critical parts, especially brakes, brake mounts and rotors, installed or inspected by a qualified bicycle or e-bike technician if you are not experienced;
- inspect and test the product (for example, test brakes at low speed) before normal riding;
- not modify a product, or use it outside its stated specifications (such as a higher voltage than listed);
- follow the e-bike laws where you ride (some upgrades may affect whether your e-bike is road-legal in your area).
Incorrect installation, modification, misuse, accidents and failure to follow safety instructions can damage your e-bike and cause serious injury. Damage caused by these is not a product defect, but if a product is genuinely defective, our responsibilities in section 6 and under the law still apply.
8. Our responsibility
We are responsible for describing products accurately, sending you what you ordered, and dealing with defective or damaged products as set out in our policies and as required by law.
To the extent the law allows, we are not responsible for losses that were not reasonably foreseeable, or for damage caused by incorrect installation, modification, misuse or use with incompatible parts.
Nothing in these terms excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud, or under consumer protection or product safety laws, and nothing affects your statutory rights.
9. Safety reports
If a product overheats, smokes, sparks, fails while riding, or seems unsafe in any way, stop using it immediately, disconnect it from power where possible, and contact us at exaarstore@gmail.com with "SAFETY" in the subject line. We take every safety report seriously and may need to report serious incidents to the authorities.
10. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. If you live elsewhere, you keep any protections the consumer laws of your country, state or province give you.
11. Changes
We may update these terms. The version published when you place your order applies to that order.
